Terms of Service Agreement
Please read these conditions carefully before accessing platform modules
This Terms of Service Agreement (the "Agreement") is entered into between Micah Garbin ("Service Owner") and the user ("User") of the Services. By using the Services, the User agrees to be bound by the terms of this Agreement. If the User does not agree to the terms of this Agreement, they should immediately discontinue use of the Services.
Use of the Services
The Service Owner grants the User a non-exclusive, non-transferable, limited license to use the Services for personal or non-commercial purposes.
Prohibited Use
The User may not use the Services in any way that violates applicable laws, rules, or regulations or infringes upon the rights of any third party. The User may not use the Services for any commercial purposes without the express written consent of the Service Owner.
Non-affiliation and Data Disclosure
The GarbinWx MobileAlerts application and GarbinWx.org website are NOT affiliated with, endorsed by, or a representative of any government entity, including the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) or the National Disaster Risk Reduction and Management Council (NDRRMC).
Data provided through the Services is sourced from multiple publicly available sources, including but not limited to:
- • Current Weather Information from Open-Meteo.
- • Weather Radar Data from DOST-PAGASA via PAGASA MDSI.
- • Weather Alerts and Warnings from DOST-PAGASA via PAGASA Public CAP Alerts.
Important Safety Notice
The Services provide weather data and alerts as an additional resource for your awareness and convenience. While we strive for accuracy, the information provided may not be complete, timely, or error-free. The Services should not be considered a primary source of official weather warnings or a substitute for professional judgment.
You are responsible for your own safety and the safety of those around you. Always confirm critical information from multiple official sources, such as the NDRRMC and PAGASA, and follow all directions from local authorities. In any emergency, your first priority should be to take appropriate safety measures and not solely rely on these Services.
Limitation of Liability
While we do our best to ensure data integrity, the Service Owner shall not be liable for any damages or injuries arising out of the use or inability to use the Services, including but not limited to, damages for loss of profits, loss of data, or other intangible losses. GarbinWx cannot be held liable for any damages or injuries resulting from the use or inability to use these Services.
Intellectual Property
The Services and all intellectual property rights therein are and shall remain the property of the Service Owner. The User agrees not to copy, modify, or distribute the Services or any portion thereof without the express written consent of the Service Owner, unless the image is explicitly attached with a Creative Commons (CC) license indicating otherwise.
Indemnification
The User agrees to indemnify and hold harmless the Service Owner, its affiliates, and their respective directors, officers, employees, and agents from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of the User's use of the Services.
Termination
This Agreement may be terminated by either party at any time for any reason. Upon termination, the User must immediately cease all use of the Services.
Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or representations, whether written or oral, relating to the Services.
Use Agreement
By using the Services, the User acknowledges that they have read this Agreement, understand it, and agree to be bound by its terms and conditions.
